Terms and Conditions of Participation

§ 1 Booking competition

The booking competition is organised by Hapag-Lloyd Cruises (HLC), a TUI Cruises GmbH company.

§ 2 Participation

(1) Persons of legal age are eligible to participate.

(2) A person takes part in the booking competition by sending a fixed booking via the entry form >> from 14 January 2025 until 14 March 2025. The booking competition applies to any cruise of Hapag-Lloyd Cruises. For every new booking made by an existing customer, the participant/the travel agency will be entered into the draw with 1 entry; for a new Hapag-Lloyd Cruises customer, the participant/the travel agency will be entered into the draw with 2 entries. The winner will be drawn from all entries after the closing date.The conditions of participation are thereby recognised. The participant is responsible for the accuracy of his/her email and/or postal address.

(3) In order to participate in the competition, it is essential that all personal details are correct. Failure to do so may result in exclusion in accordance with § 3 (4). 

§ 3 Exclusion from the competition

(1) Employees of TUI Cruises GmbH and their respective relatives are excluded from participation.

(2) HLC reserves the right to exclude persons from the competition in the event of a breach of these conditions of participation.

(3) Persons who use unauthorised aids or otherwise gain advantages through manipulation are also excluded. In such cases, prizes may also be subsequently cancelled and reclaimed.

(4) Anyone who provides false personal details may be excluded from the competition.

§ 4 Realisation and processing

(1) The winners will be notified by HLC in writing by email in week 12 (2025) and may be published by name on www.hlc-agentcompass.com. The winner expressly agrees to this form of publication.

(2) The tour operator is Hapag-Lloyd Cruises, a company of TUI Cruises GmbH. The tour operator's terms and conditions of travel apply. The cruise won is not transferable to other persons and cannot be exchanged for other prizes. The value of the cruise price cannot be paid out in cash. It is not possible to postpone the cruise to another date. In the event of non-commencement of the selected cruise, all claims shall lapse. The non-cash prizes will be sent by HLC or a third party commissioned by HLC by forwarding agent, parcel service or post to the postal address specified by the winner.

Deliveries are usually made Monday to Friday between 8.00 am and 6.00 pm. If the haulage company does not find anyone at the winner's address or at the alternative address, a message will be left. The winner must bear the costs of a new delivery.

(3) The claim to the prize cannot be assigned.

(4) Complaints relating to the organisation of the booking competition must be submitted to HLC in writing within 14 days of the reason for the complaint becoming known, stating the name of the competition. Complaints made by telephone or late complaints will not be processed.

§ 5 Premature termination of the competition

HLC reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. HLC will make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, it is not possible to guarantee the proper organisation of the competition. If such a termination is caused by the behaviour of a participant, HLC may demand compensation from this person for the damage incurred.

§ 6 Data protection

HLC undertakes to comply with the statutory provisions on data protection. In this context, reference is made in particular to the Hapag-Lloyd Cruises Data Protection Policy.

§ 7 Liability

(1) HLC shall be released from all obligations upon delivery of the prize, unless an earlier point in time results from these provisions.

(2) HLC shall only be liable for damage caused by HLC or one of its vicarious agents wilfully or through gross negligence or through the breach of cardinal obligations. This shall not apply to damages caused by injury to life, body and/or health.

The above limitation of liability applies in particular to damages caused by errors, delays or interruptions in the transmission of data or similar in the event of faults in the technical systems or the service, incorrect content, loss or deletion of data, viruses.

§ 8 Miscellaneous

(1) Legal recourse is excluded (from the age of 18).

(2) The law of the Federal Republic of Germany shall apply exclusively. The place of jurisdiction is Hamburg.

(3) Should individual provisions of these terms of use be or become invalid, this shall not affect the validity of the remaining terms of use.

(4) These Terms and Conditions of Participation may be amended by HLC at any time without separate notification.
